Fogarty is a highly experienced bankruptcy and restructuring attorney who represents businesses, creditors, trustees, and other parties in complex bankruptcy matters, business disputes, and high-stakes litigation. He is known for combining sophisticated bankruptcy knowledge with practical, aggressive advocacy aimed at protecting his clients’ interests and achieving results in difficult and often rapidly evolving circumstances.

Mr. Fogarty has substantial experience leading companies through Chapter 11 reorganizations, including numerous successful cases involving businesses in real estate, manufacturing, healthcare, retail, software development, and other industries. He has also represented creditors and other stakeholders in significant Chapter 11 proceedings throughout the country, as well as debtors, trustees, and other parties in Chapter 7 cases and out-of-court restructurings and workouts. His experience includes successful Subchapter V reorganizations and complex bankruptcy transactions and disputes.

A significant part of Mr. Fogarty’s practice involves bankruptcy litigation and contested matters. He represents clients in disputes arising from insolvency, creditor claims, the automatic stay, avoidance actions, asset sales, plan confirmation, fiduciary issues, and other matters requiring decisive advocacy in bankruptcy court. His litigation experience allows him to approach a bankruptcy case not simply as a restructuring exercise, but as a strategic legal dispute in which preserving leverage, challenging opposing claims, and positioning a client for the best possible outcome can be critical.

Before joining Stichter, Riedel, Blain & Postler, P.A. in 2006, Mr. Fogarty clerked for the United States Bankruptcy Court for the Middle District of Florida, Tampa Division, following his graduation magna cum laude from the University of Florida College of Law, where he was a member of the Order of the Coif and served on the Senior Editorial Board of the Florida Law Review.

Mr. Fogarty is Board Certified in Business Bankruptcy Law by the American Board of Certification, a distinction recognizing substantial experience and demonstrated proficiency in the field. He has been recognized by The Best Lawyers in America since 2018 in Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law and Litigation – Bankruptcy.
