Court Considers and Approves Settlements Totaling in Excess of $23 Million in Involuntary Case – October 27, 2015

At multiple hearings held between October 5 and October 27, 2015, Bankruptcy Judge Michael G. Williamson considered and approved settlements with five different parties in the Fundamental Long Term Care, Inc. involuntary chapter 11 case, totaling $23,700,000.  The firm represented the petitioning creditor and six other probate estates holding wrongful death and personal injury claims in the hundreds of millions of dollars.  The Court also considered and approved a resolution of disputes between the probate estates and the chapter 7 trustee and her professionals on the allocation of the settlement funds between the bankruptcy estate and the probate estates.
