“Un-Till We Get it Right: Applying Industry Standards to Cram-Down Rates,” an article authored by Edward Peterson and Richard Gaudet, was selected for publication in the ninetieth annual volume of the American Bankruptcy Law Journal. The ABLJ has been published quarterly by the National Conference of Bankruptcy Judges (originally under the title “Referee’s Journal”) since 1926, and is widely regarded as one of the most prestigious scholarly bankruptcy law reviews in the country. The article discusses the formula for cram-down interest rates adopted by the Supreme Court in Till v. SCS Credit Corp. and advocates a straightforward approach for computing a Till rate based on traditional banking standard.
